The Supreme Court has given a big decision. The court has given recognition to the Uttar Pradesh Madrasa Education Act 2004 and now 16 thousand madrasas will continue to run in UP and education will continue in them, but the court has given a decision which has given permission to teach but these rights of the madrasas have been snatched away. Because the court has also said that madrassas will not be able to give higher education degrees to children. That is, students in madrassas will be able to get education till class 12th and will not be able to take degrees given by the name of Fazil and Kamil for under graduation and post graduation because it is against the UGC rules.
Big decision of Supreme Court, but…
Chief Justice D.Y. Chandrachud, Justice Manoj Mishra and Justice JB Pardiwala, in its decision regarding the Madrasa Act, said that the Madrasa Act is within the legislative competence of the state assembly, but the provisions of the Madrasa Act which want to regulate higher education degrees like Fazil and Kamil. They are unconstitutional as they violate the UGC Act. That's why madrassas will not be able to give degrees to Kamil and Fazil.
Madrasas will be able to give this degree
Let us tell you that already the Madrasa Board has been giving under graduation degree under the name Kamil and post graduation degree under the name Fazil and diploma is also given from the Madrasa, which is called Kari. Apart from this, Madrasas have also been conducting the examination of Munshi Maulvi (10th class) and Aalim (12th class). During the hearing in the court, the Uttar Pradesh government also raised questions on the graduation and post-graduation education of Madrasa Board and said that on the basis of this the youth are not able to get jobs in the state and central government. Madrassas have Fazil and Kamil degrees for higher education.
The state government has argued
The state government argued that the Fazil and Kamil degrees awarded by Madrassas are neither equivalent to university degrees nor equivalent to the courses taught by the Board, hence, graduation and post graduation from the Madrassa Board. Students doing so may be eligible only for jobs that require high school or intermediate qualifications.
